Court filing says Fine's wife slept with players (AP)

SYRACUSE, N.Y. ? An affidavit filed in a slander suit against Syracuse University and basketball coach Jim Boeheim says the wife of fired assistant Bernie Fine had sex with players, and several people associated with the program knew about it, including Fine.

In the affidavit, Bobby Davis, a former ball boy with the men's team, says he was present on several occasions with basketball players when he heard them speaking of having sex with Laurie Fine. Davis said players joked about it and it seemed to be an openly known fact that Laurie Fine had sex with basketball players. A lawyer for Laurie Fine said the accusations were "disgusting."

After Davis and his step-brother, Mike Lang, accused Bernie Fine of molesting them when they were boys, Boeheim vehemently defended his longtime friend and assistant coach. He said Davis was lying to cash in on the publicity generated by a sexual abuse scandal unfolding at Penn State University. The Hall of Fame coach later backed off, saying he based his defense on loyalty and two previous claims of abuse against Fine that authorities could not substantiate.

Boeheim apologized after a third accuser came forward at the end of November and a years-old audiotape surfaced of a phone conversation between Davis and Laurie Fine that some have interpreted as Fine acknowledging Davis was abused by her husband.

In December, Davis and Lang filed a slander suit in state court. The affidavit filed Monday repeatedly makes the point that Davis believes Boeheim knew or should have known what his players were up to. He also believes Boeheim should have backed his accusations.

"He knew or purposefully chose to ignore Fine and his wife's behavior," Davis said in the affidavit. "He had every reason to know that I was telling the truth, but he instead lashed out at me and called me and my brother liars."

Lawyers for Boeheim and Syracuse University did not immediately return calls seeking comment.

The court document also says Davis spoke directly to Bernie Fine about his wife's sexual relationships with players and that "Bernie Fine did not react in the slightest."

A lawyer for Laurie Fine calls the accusations in the affidavit a "desperate" attempt to keep the suit alive.

"Only the news media can think that 20-year-old hearsay is newsworthy if it is salacious enough," Edward Z. Menkin said in an email to The Associated Press. "This is both desperate and disgusting, an example of an irresponsible and unprofessional lawyer flailing about to keep a dying lawsuit in the public eye."

The affidavit was filed Monday in New York State Supreme Court by high-profile lawyer Gloria Allred.

"If Laurie Fine was having multiple sexual relationships with basketball players, then the university must explain how this could have been taking place for years right under Coach Boeheim's nose without his being aware of it and without the university's doing anything about it," Allred wrote in an email to The Associated Press.

Davis, now 40, and Lang claim they were repeatedly forcibly touched by Fine in the 1980s. Fine, who was fired Nov. 27, has not been charged and has denied any wrongdoing. His lawyer declined comment Tuesday.

Davis tried to get Syracuse police to investigate Bernie Fine in 2002 but was told the statute of limitations had expired. The same was true of any charges brought by Lang.

The U.S. attorney's office is investigating the claims of a third man, 23-year-old Zach Tomaselli of Lewiston, Maine, who says Fine abused him in a Pittsburgh hotel room in 2002.

My timing couldn?t have been better.?

A couple of days ago I suggested that you needed to take the numbers game called ?Sudoku? seriously if you were to become a successful investor.?

In yesterday?s Wall Street Journal, a book review on the very subject appeared, titled Taking Sudoku Seriously.? ?

Okay, Okay, the book review didn?t directly correlate Sudoku with investment success, but it was an interesting article, nonetheless.

What does Sudoku have to do with successful investing and reaching your financial goals??

Not much, you say?? Well, I?m with you.?

I?d be hard pressed to present any evidence of any correlation between reaching your financial goals and?mastering the the game of Sudoku.?

But, what happens if we exchanged some words on the above statement?? It would read something like this. . .

What does (following the stock market, picking top companies, keeping up with world events and economic news) have to do with successful investing and reaching your financial goals??

Not much, you say?? Well, I?m with you.? I?d be hard pressed to present any evidence of any correlation between reaching your financial goals and (following the stock market, picking top companies, keeping up with world events and economic news).?

Ah, now you probably aren?t so ready to agree with the above statement.?

I can assure you that the entire industry of Wall Street would vehemently disagree.? Why do I know that?? Because they continue to bombard society with the opposite notion ? that (following the stock market, picking top companies, keeping up with world events and economic news) IS important to you reaching your financial goals.?

Did anyone watch the recently completed Australian Open Tennis tournament?? Financial firms flooded the advertising airways with the myth that somehow (following the stock market, picking top companies, keeping up with world events and economic news) is vital to your success.?

One ad in particular caught my eye, that of a gorgeous young woman standing on a beach with her iPad in hand, checking charts, stocks, graphs and trends.? Who sponsored the ad?? Fidelity, of course, in conjunction with Apple.?

Hmm.? If our culture says it is important, it must be important.?

Or is it??

Arab League halts observer mission in Syria (AP)

BEIRUT ? The Arab League halted its observer mission in Syria on Saturday because of escalating violence that killed nearly 100 people the past three days, as pro-Assad forces battled dissident soldiers in a belt of suburbs on the eastern edge of Damascus in the most intense fighting yet so close to the capital.

The rising bloodshed has added urgency to new attempts by Arab and Western countries to find a resolution to the 10 months of violence that according to the United Nations has killed at least 5,400 people as Assad seeks to crush persistent protests demanding an end to his rule.

The United Nations is holding talks on a new resolution on Syria and next week will discuss an Arab peace plan aimed at ending the crisis. But the initiatives face two major obstacles: Damascus' rejection of an Arab peace plan which it says impinges on its sovereignty, and Russia's willingness to use its U.N. Security Council veto to protect Syria from sanctions.

Syria's Interior Minister Mohammed Shaar vowed the crackdown would go on, telling families of security members killed in the past months that security forces "will continue their struggle to clean Syria's soil of the outlaws."

Government forces launched a heavy assault on a string of suburbs and villages on the eastern outskirts of Damascus, aiming to uproot protesters and dissident soldiers who have joined the opposition, activists said.

Troops in tanks and armored personnel carriers attacked the suburbs of Kfar Batna, Saqba, Jisreen and Arbeen, the closest of which lie only a few miles from downtown Damascus, said the Local Coordination Committees activist network and the British-based Syrian Observatory for Human Rights. Dissident troops were fighting back against the attackers, they said.

In a nearby suburb, Douma, gunmen ambushed a bus carrying army officers, the state-run news agency SANA, calling the attackers "terrorists." It said seven officers were killed.

The assault in the suburbs seemed to be a sign of the growing presence of dissident soldiers closer to the capital. Although the tightly controlled Damascus has been relatively quiet since the uprising began, its outskirts have witnessed intense anti-regime protests and army defectors have become more visible and active in the past few months.

"The fighting today is the most intense near the capital since the uprising began," said Rami Abdul-Rahman who heads the Observatory for Human Rights. "The Syrian regime is trying to finish the uprising militarily now that the case is being taken to the United Nations."

In Saqba, electricity and phone lines were cut off and mosque loudspeakers told residents to say in lower floors for fear high buildings might get hit in the fighting, said Omar Hamza, an activist in the district. "Random shelling and sound of explosions terrified the people," he told The Associated Press.

He said army defectors had managed to stop the advancing troops. The regime forces are putting all their force to finish the Free Syrian Army and protesters in the Damascus suburbs," Hamza said.

The Free Syrian Army force of anti-regime military defectors is based in Turkey, and its fighters frequently try to cross into Syria through the mountainous border area in the northwest. SANA reported that Syrian troops prevented gunmen from crossing in from Turkey on Saturday in fighting that it said left many of the infiltrators killed or wounded.

The LCC and the Observatory also reported intense fighting between troops and defectors in the town of Rastan near the restive central city of Homs.

The Observatory said at least 36 people, were killed across the country Saturday, including 17 civilians, three defectors and 16 troops, while the LCC said 20 died, half of them in Homs province, which has been one of the areas hardest hit by government crackdowns. The new deaths come after two days of bloody turmoil killed at least 74 people, including small children.

In the eastern oil-rich province of Deir el-Zour, an oil pipeline took a direct hit and caught fire as government troops shelled a nearby town, the two groups also said, reporting at least one person dead. State media blamed "terrorists" in the attack.

The month-old Arab League observer mission in Syria had come under widespread criticism for failing to bring a halt to the regime's crackdown. Gulf states led by Saudi Arabia pulled out of the mission Tuesday, asking the U.N. Security Council to intervene.

Arab League Secretary-General Nabil Elaraby said in a statement that the organization decided to halt the observers' work immediately because of the increasing violence, until the League's council can meet to decide the mission's fate.

He sharply criticized Damascus for the spike in bloodshed, saying the regime has "resorted to escalating the military option in complete violation of (its) commitments" to end the crackdown, Elaraby said. He said the victims of the violence have been "innocent citizens," in an implicit rejection of Syria's claims that it is fighting "terrorists."

Syria's state-run news agency quoted an unnamed official saying Damascus "regrets and is surprised" by the Arab League decision after Syria agreed to extend the observer's mission for another month. The official said the halt aims "to pressure the talks in order to call for external intervention in Syria's internal affairs," referring to the U.N. talks.

Elaraby's deputy, Ahmed Ben Heli, told reporters that the around 100 observers will remain in Damascus while their mission is "reevaluated." He suggested the observers could resume their work in the future...

Elaraby and the prime minister of Qatar were set to leave for New York on Sunday to seek U.N. support for the latest Arab plan to end Syria's crisis. The plans calls for a two-month transition to a unity government, with Assad giving his vice president full powers to work with the proposed government.

Syria has rejected the proposal, saying it violates its sovereignty. Elaraby had previously been due to travel Saturday, but his trip was pushed back to Sunday with no explanation.

The U.N. Security Council began closed-door negotiations Friday on a new Arab-European draft resolution aimed at resolving the crisis, but Russia's envoy said he could not back the current language as it stands.

Any resolution faces strong opposition from China and Russia, and both nations have veto power. Russia's U.N. Ambassador Vitaly Churkin told reporters that the text introduced by new Arab Security Council member Morocco has "red lines" for Moscow, but he's willing to "engage" with the resolution's sponsors.

Churkin said those lines include any indication of sanctions, including an arms embargo. "We need to concentrate on establishing political dialogue," he said.

Peter, Paul and Mary bassist Dick Kniss dies at 74 (AP)

SAUGERTIES, N.Y. ? Dick Kniss, a bassist who performed for five decades with the folk trio Peter, Paul and Mary and co-wrote the John Denver hit "Sunshine on My Shoulders," has died. He was 74.

Kniss died Wednesday of pulmonary disease at a hospital near his home in the Hudson Valley town of Saugerties, his wife, Diane Kniss said.

Kniss was born in Portland, Ore., and was an original member of Denver's 1970s band. He also played with jazz greats including Herbie Hancock and Woody Herman.

Active in the 1960s civil rights movement, Kniss performed at benefits for a range of causes and played during the first celebration of Martin Luther King Jr.'s birthday as a national holiday.

Peter, Paul and Mary's Peter Yarrow said in a statement that Kniss was "our intrepid bass player for almost as long as we performed together.

"He was a dear and beloved part of our closest family circle and his bass playing was always a great fourth voice in our music as well as, conceptually, an original and delightfully surprising new statement added to our vocal arrangements," Yarrow said.

Barge Carrying Atlas Rocket Crashes Into Bridge (SPACE.com)

A barge ferrying an Atlas 5 booster and other rocket parts to their Florida launch site crashed into a Kentucky bridge late Thursday (Jan. 26), but the flight hardware appears to be undamaged, officials say.

The 312-foot (95-meter) cargo ship Delta Mariner smashed into a bridge over the Tennessee River in southwest Kentucky at 9:15 p.m. EST Thursday (0215 GMT Friday), causing a portion of the span to collapse. Though several cars were crossing the bridge at the time, the accident caused no injuries.

The Delta Mariner was carrying one Atlas 5 rocket and several other components from the United Launch Alliance (ULA) factory in Decatur, Ala., to Cape Canaveral, Fla. The flight hardware will be used for two upcoming launches from the Cape, including one slated to blast off April 27.

"The 312-foot vessel was carrying an Atlas booster and Centaur upper stage for the Air Force's Advanced Extremely High Frequency (AEHF-2) mission scheduled to launch in April, and an interstage adapter for NASA's Radiation Belt Storm Probes (RBSP) mission scheduled to launch in August," ULA officials said in a statement Friday. "There is no schedule impact to either launch date expected at this point."

The rocket parts seem to have survived the accident intact.

"There's no damage to the cargo," said Sam Sacco, spokesman for Foss Marine, the company that owns and operates the Delta Mariner. "Based on what we know right now, there's no real damage to the vessel itself, either."

"The hardware is well instrumented, and all data from these instruments is being reviewed to confirm that there were no issues," they said.

The Delta Mariner, which was commissioned in 2002, transports flight hardware from ULA's Decatur factory to Cape Canaveral and another launch site, California's Vandenberg Air Force Base. It's capable of carrying up to three common booster cores, which are each as long as a 737 jet's fuselage.

The ship can ply both rivers and the open ocean, and it can navigate waterways as shallow as 9 feet (3 m), according to ULA officials. The trip to Cape Canaveral covers about 2,100 miles (3,380 kilometers) and takes eight to 10 days.

Sacco said the cause of the accident ? which apparently did not result in any fuel spills or other obvious environmental problems ? remains a mystery for now.

"The company's been doing it for over 10 years. Exactly why this happened, I can't tell you," Sacco told SPACE.com. "The Coast Guard will lead an investigation into the cause, and that will be the definitive explanation as to what happened."

The Atlas 5 rocket is an expendable booster that first launched in 2002. Since then, it has logged about two dozen liftoffs, with 100 percent mission success, according to ULA officials. NASA's Curiosity Mars rover blasted off atop an Atlas 5 this past November.

US sued over Navy sonar tests in whale waters

Environmental groups sued the Obama administration on Thursday for granting the Navy permits to test underwater sonar?along the West Coast?-- and potentially harass up to 650,000 porpoises, seals, dolphins and whales over a five-year period.

The alliance said it wasn't seeking to stop the testing but to scale it back, especially at certain times and in waters important for feeding and giving birth.

Several studies have found that marine mammals can hear low-frequency sonar, which is magnified under water, and periodically dolphins and even whales have been found with perforated ear drums.


The National Marine?Fisheries Service "fell down on the job and failed to require the Navy to take reasonable and effective actions to protect" marine mammals, Steve Mashuda, an attorney for the law firm Earthjustice,?said in a statement.

The lawsuit, filed in U.S. District Court in San Francisco, claims that the Navy's sonar use might be strong enough to kill the animals outright. But even if it doesn't, it claims, the repeated use of sonar in certain critical habitats is unwarranted.

In 2010, the fisheries service approved the Navy's five-year plan for operations in the Northwest Training Range Complex, an area roughly the size of California that stretches from Washington state to Northern California.

Under the five-year plan, the service said it was acceptable for the Navy to incur up to 650,000 cases of harassment of marine mammals.

Regulators determined that while sonar use has been associated with the deaths of whales around the world, including the beaching of 37 whales on North Carolina's Outer Banks in 2005, there was little chance of that happening on the West Coast. The short duration of the sonar use, typically 90 minutes at a time by a single surface vessel, and reduced intensity would help prevent whale deaths, they said.

Regulators?are requiring the Navy to shut down sonar operations if whales, sea lions, dolphins or other marine mammals were spotted nearby by ships in the water.

But the plaintiffs argue that?visual mitigation is ineffective.

"Visual detection can miss anywhere from 25?95 percent of the marine mammals in an area,? stated Heather Trim, policy director?for People For Puget Sound. "It?s particularly unreliable in rough seas or in bad weather. We learn more every day about where whales and other mammals are most likely to be found ? we want NMFS to put that knowledge to use to ensure that the Navy?s training avoids those areas when marine mammals are most likely there."

A spokeswoman for the Navy declined to comment, saying she had not seen the lawsuit, and the fisheries service did not immediately return an email seeking comment.

Nobu Matsuhisa, Renowned Chef, To Headline A Crystal Cruise

Known for his high-end fusion cuisine, Chef Nobu Matsuhisa is now branching out to the high seas. The Japanese chef will be headlining a May sailing of the Crystal Serenity.

Onboard, Matsuhisa will serve as Executive Chef in Silk Road and the Sushi Bar, his restaurant with the cruise line, according to a company press release. He will also host cooking classes, cooking demonstrations, sign cookbooks and take pictures with guests.

Matsuhisa is the chef behind the Nobu and Matsuhisa restaurants, which can be found around the globe in locations like Aspen, the Bahamas, New York, Las Vegas and Mykonos. His Japanese-Peruvian fusions have been available onboard the Symphony and Serenity for a few years.

And, yes, his famous black cod with miso is on the menu (PDF).

The 12-day western European cruise will depart from Dover, England on May 24. Ports of call include Lisbon, Monte Carlo, Gibraltar, Florence and Rome. Cabins start at $3,955 per person.

Palestinians take step toward elections, unity (AP)

GAZA CITY, Gaza Strip ? Palestinian political rivals Hamas and Fatah on Tuesday took a first practical step toward elections and possible unity by opening an office for voter registration in the Gaza Strip.

Presidential and parliament elections are envisioned for late spring, though a date has not been set. Elections are at the center of reconciliation efforts between the Islamic militant Hamas and Fatah, the movement of internationally backed Palestinian President Mahmoud Abbas.

Hamas won parliament elections in 2006 and wrested control of Gaza from Abbas by force a year later, leaving him with only the West Bank. The Gaza office of the Central Elections Commission was closed after the 2007 takeover and reopened Tuesday.

Updating Gaza voter records is a key part of election preparations, which officials have said would require several weeks. Elections could be held within three months of the completion of preparations. Abbas would set the date by decree.

In the West Bank, Israeli forces detained a Hamas lawmaker, the fifth such arrest in five days, prompting Hamas accusations that Israel is trying to sabotage the planned elections. Hamas has said it would only participate in elections if its candidates are safe from arrest by Israel.

"Every time we move toward reconciliation and reactivating the Palestinian parliament, we see Israel targeting our lawmakers in the West Bank," said Ismail Ashkar, a Hamas lawmaker.

Hamas said that in the latest incident, lawmaker Abdel Jaber Fuqaha was taken from his home in the West Bank city of Ramallah early Tuesday.

Israel's military confirmed the arrest but declined further comment.

Israel considers Hamas a terrorist organization. The group has carried out scores of deadly attacks against Israelis but has largely held its fire in recent years.

Currently, 24 of 45 Hamas legislators from the West Bank are in Israeli detention on charges of membership in an illegal organization, Hamas said. Hamas lawmakers have been subject to arrest by Israel since the group defeated Fatah in the 2006 election. Several lawmakers have been detained repeatedly.

Asked about the recent string of arrests, Israeli officials denied claims that they are politically motivated. The officials, speaking on condition of anonymity because they were not authorized to talk to reporters, declined further comment.

Palestinian peace negotiator Saeb Erekat, a leader in Fatah, condemned the recent arrests as a "flagrant act of aggression" that undermines prospects for peace. "With these actions, Israel exposes the farcical nature of its peace rhetoric," he said.

In recent months, Hamas and Fatah have tried to reconcile but have had trouble moving forward because of continued mistrust. Next week, Abbas is to meet with Hamas leader Khaled Mashaal in Cairo to try to break the impasse.

WASHINGTON (Reuters) ? An Idaho man pleaded not guilty on Tuesday to attempting to assassinate President Barack Obama and to other criminal charges for allegedly shooting at the White House in November.

His attorney entered the not guilty plea on behalf of Oscar Ortega-Hernandez to a 17-count indictment that included charges of damaging the White House, illegal use of a firearm, assault with a dangerous weapon and interstate transportation of a firearm and ammunition.

Obama and first lady Michelle Obama were in California at the time and no one was injured when Ortega-Hernandez allegedly opened fire at the executive mansion with a semi-automatic weapon on November 11. At least two bullets hit the outside of the building.

During a five-minute court hearing, Ortega-Hernandez never addressed the judge. His defense attorney, assistant federal public defender David Bos, said his client would be asserting his right to a speedy trial.

Ortega-Hernandez, 21, who faces up to life in prison if convicted, was arrested and has been held in custody since shortly after the shooting. Magistrate Judge Deborah Robinson ordered that he remain in custody.

A doctor has determined that Ortega-Hernandez, who has referred to himself as a modern day Jesus Christ and who allegedly has called Obama the devil, was mentally competent to stand trial.

The next hearing in the case was scheduled for February 10.

U.N. probes new charges of peacekeeper sex abuse in Haiti (Reuters)

UNITED NATIONS (Reuters) ? The U.N. peacekeeping mission in Haiti, whose members have been accused of rape, assault and sparking a cholera epidemic in the country, is investigating new allegations that peacekeepers sexually abused minors.

"The U.N. Secretariat regrets to confirm that, on 16 January 2012, the U.N. mission in Haiti, MINUSTAH, alerted headquarters about two allegations of sexual exploitation and abuse involving minors in Haiti," spokesman Martin Nesirky told reporters on Monday.

He said one of the cases involved U.N. police officers based in the capital Port-au-Prince.

"The accused officers have been removed from their duties to reduce any contact with the local population while the investigation is underway," he said.

He added that the second case involved at least one member of a U.N. police unit in Gonaives.

"The United Nations is outraged by these allegations and takes its responsibility to deal with them extremely seriously," Nesirky said.

MINUSTAH is no stranger to negative press in Haiti.

Many Haitians have called for the complete withdrawal of the force due to allegations that Nepalese U.N. troops brought a deadly cholera epidemic to the country after their camp latrines contaminated a river. That sparked riots in 2010.

Last year, the U.N. force faced renewed public protests over allegations a group of Uruguayan troops raped a man. In December the United Nations said it was investigating allegations of assault and attempted homicide by Brazilian peacekeepers.

In October 2011, the U.N. Security Council voted to reduce the size of the unpopular force by 2,750, bringing MINUSTAH to just under 10,600 troops and police. That brought the size of the force back to its level before the January 2010 earthquake that devastated Port-au-Prince.

FORT WORTH, Texas - Rangers slugger Josh Hamilton says he's feeling good during offseason workouts following sports hernia surgery and expects to be right on schedule for the start of spring training next month.

Hamilton, who had surgery in November, was hurt throughout the postseason for the AL champion Rangers. He had a torn abdominal muscle and torn adductor muscles in his left leg.

During a stop with the Rangers winter caravan Monday night, Hamilton said everything feels good while running, swinging the bat and throwing. He's also been squatting weight and doing agility exercises.

Hamilton is going into the final year of his contract. The 2010 AL MVP says he'd like any talks with the Rangers about a new deal done before spring training starts.

Doomed liner's captain trades blame with shipowners (Reuters)

GIGLIO, Italy (Reuters) ? The operators of the Costa Concordia faced questions over their share of the blame for the shipwreck, as divers recovered another body from the stricken liner on Sunday, bringing the known death toll to 13.

Captain Francesco Schettino is accused of steering the 290 meter-long cruise ship too close to shore while performing a maneuver known as a "salute" in which liners draw up very close to land to make a display.

Schettino, who is charged with multiple manslaughter and with abandoning ship before the evacuation of its 4,200 passengers and crew was complete, has told prosecutors he had been instructed to perform the maneuver by operator Costa Cruises.

Prosecutors say he steered the ship within 150 meters of the Tuscan island of Giglio, where it struck a rock that tore a large gash in its hull, causing it to keel over.

It is now lying on its side on an undersea ledge, half-submerged and in danger of sliding into deeper waters.

As the search continued into a ninth day, divers found the body of a woman on a submerged deck near the bow of the vessel, bringing the total number of known dead to 13, only eight of whom have been identified.

Costa Cruises have said they were not aware of any unsafe approaches so close to the shore and have suspended Schettino, saying he was responsible for the disaster.

According to transcripts of his hearing with investigators, Schettino has disputed that claim, saying Costa had insisted on the maneuver to please passengers and attract publicity.

"It was planned, we should have done it a week earlier but it was not possible because of bad weather," Schettino said.

"They insisted. They said: 'We do tourist navigation, we have to be seen, get publicity and greet the island'."

Italian newspapers have also published photographs of the Costa Concordia apparently performing the "salute" close to other ports including Syracuse in Sicily and the island of Procida, which is near Naples and Schettino's hometown of Meta di Sorrento.

Schettino also said the black box on board had been broken for two weeks and he had asked for it to be repaired, in vain.

In the hearing, Schettino insisted he had informed Costa's headquarters of the accident straight away, and his line of conduct had been approved by the company's marine operations director throughout a series of phone conversations.

He acknowledged, however, not raising the alarm with the coastguard promptly and delaying the evacuation order.

"You can't evacuate people on lifeboats and then, if the ship doesn't sink, say it was a joke. I don't want to create panic and have people die for nothing," he said.

Costa, a unit of Carnival Corp, the world's largest cruise line operator, says Schettino lied to the company and his own crew about the scale of the emergency.

Documents from his hearing with a judge say he had shown "incredible carelessness" and a "total inability to manage the successive phases of the emergency."

Taped conversations show ship's officers told coastguards who were alerted by passengers that the vessel had only had a power cut, even after those on board donned lifevests.

UNREGISTERED PASSENGERS?

Adding to the growing debate about the ship's safety standards, Franco Gabrielli - head of Italy's Civil Protection authority which is coordinating the rescue operations - said a number of unregistered passengers may have been on board.

Relatives of a missing Hungarian woman told authorities she was on the Costa Concordia with a member of the crew, but her name was not on the list of passengers, he said.

"In theory, there could be an unknown number of people who were on the ship and have not been reported missing because they were not registered," Gabrielli said.

Of the 13 bodies found, only 8 had been identified - four French nationals, an Italian, a Hungarian, a German and a Spaniard. At least 20 people are still unaccounted for.

Minor pollution from detergents and disinfectants aboard the shipwreck had been detected in the waters around the vessel but there was no sign that the heavy fuel in its tanks was leaking, Gabrielli said.

He said tests were being carried out daily on the waters around the ship and a nearby desalination plant that provides drinking water for the island's residents.

"The tests for toxic substances are negative so far," Gabrielli said. "The only significant elements detected, which luckily are not worrying yet, relate to ... detergents and disinfectants used on the ship, for the swimming pool or to clean the bathrooms for example."

Environment experts have warned that contamination of the pristine waters around Giglio, which is in the middle of a national marine park, is already under way and it is imperative to start recovering the fuel oil as soon as possible.

Agency: Iran shuts down shops selling Barbie dolls

(AP) ? Police have closed down dozens of toy shop for selling Barbie dolls, part of a decades-long crackdown on signs of Western culture in Iran, the semiofficial Mehr news agency reported Friday.

Mehr quoted an unnamed police official as saying police confiscated Barbie dolls from toy shops in Tehran in a "new phase" of its crackdown against "manifestations of Western culture."

Barbie dolls are sold wearing swimsuits and miniskirts in a society where women must wear head scarves in public, and men and women are not allowed to swim together.

A ban on the sale of Barbie dolls, designed to look like young Western women, was imposed in the mid-1990s.

In 1996, a government-backed children's agency called Barbie a "Trojan horse" sneaking in Western influences like makeup and revealing clothes.

Authorities launched a campaign of confiscating Barbie dolls from toy shops in 2002, denouncing what they called the un-Islamic characteristics of the uniquely American doll. The campaign was eventually dropped.

Also in 2002, Iran introduced its own competing dolls ? twins Dara and Sara ? who were designed to promote traditional values with modest clothing and pro-family stories. But the dolls proved unable to stem the Barbie tide.

Despite bans on many Western books, movies, satellite TV channels, music, haircuts and fashions, young people maintain their interest in Western culture.

Even channels of Iran's state TV broadcast several Western and Hollywood films every week. Islamists have repeatedly tried to fight what they see as a Western cultural "invasion" since 1979 Islamic Revolution that ousted a pro-Western monarchy.

Since then, importing Western toys has been discouraged by a regime that seeks to protect Iranians from what it calls the negative effects of Western culture.

In 2008, the Iranian judiciary warned against the "destructive" cultural and social consequences and "danger" of importing Barbie dolls and other Western toys.

Even so, Iranian markets have been full of Western toys aimed at Iranian children. One-third of Iran's population of 75 million are under 15 years old.

Christian Bale returns to China in new film (AP)

LOS ANGELES ? Christian Bale says he isn't concerned with what Chinese government censors approved or cut from his new film "The Flowers of War."

"I just do what I do," Bale said. "What happens after I'm wrapped is always out of my hands. It doesn't matter which country that's in. ... Which scenes get chosen, which scenes get cut, that has nothing to do with me."

The movie marks Bale's return to the country where he launched his Hollywood career in 1987 with Steven Spielberg's "Empire of the Sun." And while Bale didn't worry about intrusion into the filmmaking process, the government did publicly rebuke him for a recent run-in with state-backed guards. With a CNN camera crew in tow, Bale attempted last month to visit the home of blind activist Chen Guangcheng before being physically turned away.

In an interview before that incident, Bale said he picked "The Flowers of War," with dialogue divided about evenly between Mandarin and English, out of a desire to get outside his comfort zone and work with director Zhang Yimou.

"I have a great sense of adventure, and whatever adventure I can take out of moviemaking, I'm going to," said Bale, who won a supporting actor Oscar for last year's "The Fighter." "So I hope that not just with China but with just internationally that we'll start to get much more mixing of nationalities and film cultures. And I think we're going to get some really interesting results from that."

Bale used an interpreter to communicate with Yimou during production of "Flowers," set during the Japanese army's brutal 1937 rampaging of Nanjing. The 37-year-old actor said they used gestures and developed "a good kind of a short-hand, kind of a lingua franca" to get through scenes.

Yimou said Bale suggested changes that the director incorporated into the finished film, which like other Chinese productions was subject to review by censors. (Bale notes that while he's happy to make such suggestions, he has no hopes to direct: "I don't want the responsibility.")

The film was at the top of the Chinese box office last year and is being released in the U.S. on Friday. Bale stars as a mortician who pretends to be a priest and works to protect two groups of young women inside a Catholic cathedral during the invasion known as the Rape of Nanking.

In the interview, Bale also confirmed that July's "The Dark Knight Rises" will be his final appearance as the Caped Crusader.

"There's a time to finish anything. And this feels like the time," Bale said.

Paul McCartney hints at role in 2012 Olympics (AP)

LONDON ? Paul McCartney says he is in talks to play a role in the London 2012 Olympic celebrations.

The former Beatle says he "might be doing something" in the Olympics but is not sure what role he may play in the events.

Speaking at a promotional event for his new album on Thursday, McCartney said he will go to a meeting about the Games on Friday where he expects to learn more about "something they want me to do."

McCartney also said he might be involved in another massive British celebration this year: Queen Elizabeth II's Diamond Jubilee.

Describing himself as a "big fan of the queen," McCartney said he "could easily" participate in festivities if he is asked.

The Olympic Games take place July 27 to Aug. 12.

Being a hardcore cinephile (like Scorsese) might add a layer of enjoyment, but it certainly isn't a prerequisite for walking in the door. A sense of wonder, however, is.

Scorsese transforms this innocent tale into an ardent love letter to the cinema and a moving plea for film preservation.

'Hugo': Scorsese's humbling hommage to his favorite art

Thematic potency and cinematic virtuosity -- the production was designed by Dante Ferretti and photographed by Robert Richardson -- can't conceal a deadly inertness at the film's core.

For all the wizardry on display, Hugo often feels like a film about magic instead of a magical film...

I have seen the future of 3-D moviemaking, and it belongs to Martin Scorsese, unlikely as that may sound.

A movie that needs to be appreciated for its finer aspects and deeper meaning if it is to be appreciated properly, which is noble enough but could feel exclusive to some.

Never mind that the tone wavers and the pace is mostly plodding, the film champions all the right things and the beautifully crafted images (in 3D glory) leave a lasting impression

There are many lovely things in this film it is easy to forgive its small shortcomings

Martin Scorsese takes a left turn into family film territory in Hugo and delivers a movie that celebrates the wonders which the imagination can conjure.

An exuberant and meticulous 3D spectacle by one of the greatest filmmakers of all time.

Scorsese, now in the winter of his career, has tapped into his own childlike passion for film with this late-period masterpiece.

It's not an adventure, but a loving tribute to all the broken things, and those who would fix them.

You can practically feel time stop in sync with the audience's halted breath. It's nothing short of wizardry.

Who knew? The director who put the rage in Raging Bull the fear in Cape Fear and the mean in Mean Streets could make a family-friendly, dazzling 3D film.

In Hugo Scorsese not only tells an important story about early cinema, but delivers a film that is a passionate and convincing reminder of the essential role art and imagination should play in our lives.

Scorsese's exuberant, magical odyssey transports audiences to the dawn of cinema.

The energy that's behind all of [Scorsese's] films is definitely present here.

[Hugo is] movie that will probably appeal more to hardcore film nerds than to nine-year-olds, unless of course that youngster will grow into a movie geek. If that's the case, Hugo will be a touchstone in their cinematic development.

MRI Powered Pill-Sized Robot Swims Through Intestines

Having had to design surgical instruments to operate in in MRI imaging field (not just the magnetic field, but in the patient during a scan), I can answer this.

The warning on the machine is overly cautious. Almost any material can be put in in MRI, but should be tested. 99% would probably fail (and 99% of those can be predicted to fail). And who wants to test every friggin' thing someone wants to bring into an MRI room. Best just to say "NONE!"

But for stuff designed for the MRI, it's a different story.

There are 2 levels of compatibility: MRI safe and MRI compatible.

MRI safe means it won't hurt anyone. Don't use large pieces of ferro or paramagnetic materials, or the magnet will apply significant force. In other words, just don't use steel (plus a few other exotic alloys). And don't use long, thing wires, or you can create some induction heating from the radio waves (the R stands for resonance... radio frequency resonance).

MRI compatible means that the material won't disrupt the imaging field. Either by warping the magnetic field, messing with the radio waves, or creating discontinuities (the FFT algorithms create artifacts from abrupt hydrogen density changes. Air/interface is enough sometimes).

Turns out polymers are ideal, followed by ceramics. But a small group of diamagnetic metals work pretty well too (but still have dimension and geometry constraints). Gold, silver, lead, and copper work great. BeCu alloys can be used and replace steel.

A small item (20 mm x 5 mm dia) made of copper should be MRI safe. MRI compatible is something that has to be tested, but copper/polymer objects might not screw with the image too badly if designed well. And it makes great sense to tap the radio field for a little bit of power.
